These Terms of Use ("Terms") govern your access to and use of the StoryNight iOS application ("App") operated by StoryNight ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
StoryNight is intended for use by parents, guardians, and caregivers on behalf of children. You must be at least 13 years of age to create an account and use the App directly.
If you are a parent or guardian using this App to create stories for a child under 13, you represent that you have the authority to consent to our Privacy Policy and these Terms on behalf of the child.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes on Apple devices you own or control, subject to these Terms and Apple's App Store Terms of Service.
You may not:
The App offers a free tier that allows a limited number of story generations per month (currently 5 stories). Free-tier stories include images and basic narration features.
A Pro subscription unlocks unlimited story generation, additional narrator voices, multiple child profiles, and premium language options. Subscription prices are displayed in the App prior to purchase.
If you reinstall the App or switch devices, use the "Restore purchases" option in Settings to recover your active subscription.
You may enter custom story notes, image prompt details, and custom story type names. By providing this input, you represent that it does not contain offensive, harmful, or illegal content.
We reserve the right to implement content safety filters to prevent the generation of inappropriate content. The App includes a content safety layer to help ensure all generated stories are suitable for children.
You retain ownership of story content generated using your inputs. However, you grant us a limited licence to process your inputs through our AI pipeline to provide the service.
Stories and illustrations are generated by third-party AI models (Anthropic Claude and fal.ai FLUX). AI-generated content may occasionally be imperfect, repetitive, or unexpected. We do not guarantee that all generated content will meet your expectations.
Generated content is for personal entertainment and bedtime use only and should not be relied upon for educational accuracy.
The App, including its design, code, branding, and non-AI-generated assets, is owned by StoryNight and protected by intellectual property laws.
Stories and illustrations generated within the App are provided for your personal, non-commercial use. We do not claim ownership of the generated content; however, you may not commercialise AI-generated stories from this App without explicit written permission.
You agree not to use the App to:
The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will always be accurate or appropriate.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for your subscription in the three months preceding the claim.
We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms or if required by law.
You may stop using the App at any time. Uninstalling the App removes all locally stored data, including stories and child profiles, from your device.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.
